Provenance Note: Edward E. Barry, Jr. donated this collection of court records and supporting documents in 1975. They were acquired during research supported by a grant from the Bureau of Indian Affairs in 1972-1973 into claims by the Fort Belknap Indian Community of Montana against the United States of America. They were deposited with the permission of the U.S. Justice Department.

Historical Note: Edward E. Barry, Jr. was an Associate Professor of Soils from 1964-1966, Associate Professor of History from 1966-1972, Assistant Professor of History 1972-1976 and Professor of History 1977-1984 at Montana State University-Bozeman. He retired in 1992.

In 1946, Congress passed the Indian Claims Commission Act as an independent agency to hear and determine claims against the United States by any tribe, band or other group of American Indians residing in the United States. Grievances of an Indian tribe were brought before the three-member Commission (later expanded to five members) who were appointed by the president. Decisions were reviewed by the U. S. Court of Claims and the Supreme Court if necessary. Originally created for 10 years, the Commission lasted until 1978 when it was abolished. The U.S. Court of Claims took over pending cases. To establish its case, a tribe presented evidence about tribal history and culture by experts in anthropology, ethnology and history to establish that land claimed was rightfully attributed to that particular tribe. Tribal reservation records were also introduced. If the tribe was determined to have proven its case, the value of the land at the time the land was taken was decided, and the U. S. Government paid the tribe compensation. Some of the evidence presented to the Commission came from the records of the Bureau of Indian Affairs, Record Group 75, of the National Archives and Records Administration.

NARA series #75.19.30-3. "Unbound copies of letters sent to the Commissioner of Indian Affairs from the Superintendent of the Ft. Belknap Indian Agency. These letters are similar to those in Series 2. Letters from 1878-1899 do not duplicate those of the same dates in Series 2; however, some 1916 letters are duplicates. These letters were apparently filed separately from the bound volumes in Series 2. Topics include fiscal matters, reports of migrations of Canadian Indians and Indian raids, and an 1882 annual report describing the Ft. Belknap Agency and the daily life of the Gros Ventre and Assiniboine Indians. Arranged chronologically."

Belknap Indian Agency to farmers-in-charge, school teachers, employees, the superintendent of St. Paul's Mission school, local merchants and others pertaining to the implementation of Indian office policy and maintenance of the agency. Of particular interest are the minutes of a 1911 tribal council meeting opposing the allotment of lands to individual Indian of the Ft. Belknap Agency. NARA series #75.19.30-5. "Letters received by the Superintendent of the Fort Belknap Indian Agency from employees, school teachers, merchants, Indian trades, military officers, and other agents. Many letters from military officers deal with Indian raids; horse stealing and other disturbances. Some letters from the Canadian Northwest Mounted Police discuss the transport of stolen horses across the border. Other letters describe irrigation projects and water rights on the Milk River. A rough draft of an 1887 agreement between the Indians of the Ft. Belknap, Ft. Peck and Blackfeet agencies and the U.S. government for a diminished reservation is also included. Belknap Indian Agency to military officers, other Indian agents, employees, merchants, bankers, Indians and others. There are a few letters to the Commissioner of Indian Affairs and letters from 1878-1887 are predominantly outgoing, addressed to military officers and deal with Indian migrations, raids, and horse stealing. An 1878 letter describes raids on Ft. Belknap Indians by renegade Sioux and Sitting Bull. Outgoing letters from 1878-1887 seem to compliment letters from that period in entry 6. Other topics include tribal enrollments, grazing permits, claims for damage to crops and lands from the building of the Ft. Belknap-Dodson Reservoirs, Indian education and agency fiscal matters. The formal October 1895 agreement for a diminished Ft. Belknap Agency is also included. Arranged chronologically."

Series 20: Records relating to the Sugar Beet Program, 1906

NARA series #75.19.30-36. "Records relating to the establishment of a program of sugar beet farming for the Indians in conjunction with private industry. The program proposed that unoccupied agency land be leased to private sugar-beet companies, who would Indian labor to cultivate the beets. Indian profits would be applied to a general reservation refund or payment to individual Indian laborers and investment in annual farm machinery. Records include correspondence to the Commissioner of Indian Affairs, sugar-beet companies and others regarding the program description and implementation, leases for sugar beet farming executed by the Business Council of the Indians of Ft. Belknap, the CIA, the Superintendent and private farms."
